The Health Professions and Occupations Act (HPOA) and the 2026 BC Election

The HPOA governs doctors, nurses, psychologists, chiropractors, physiotherapists, and many other health professionals. We asked every candidate where they stand.

Election 2026: Keep politics out of health care

The Health Professions and Occupations Act (HPOA) was introduced alongside claims that it would protect the public. We are asking every candidate one question about it.

OUR MISSION

Psychologists of BC for Ethical Care and Governance works for regulation that protects the public, client confidentiality and access to care, and that keeps politics out of health care.

OUR STATEMENT

2026 Provincial election: Bringing psychologists’ priorities, every health care professional and the public into the conversation

Dear colleagues and fellow British Columbians,

With a provincial election now set for October 24, British Columbians will head to the polls on a much shorter timeline than usual. While the snap election leaves less time for pre-election engagement than we would normally undertake, we want to ensure that health care, and the issues that matter to psychologists, to every regulated health professional, and to the people we serve, remain part of the election conversation.

Why we are speaking out
The Health Professions and Occupations Act (HPOA) was introduced alongside claims that it would protect the public. We want a health-care system with strong public safety and protection, one that supports the people who provide care and is free of government control and political agenda. The HPOA, as designed, does not meet that standard and is less than British Columbians deserve.

Key priorities for BC health care
Given the limited time available, we have identified four key priorities, outlined further below, that require attention during the election and from the next government:
– End political control of health regulation and restore independent, profession-informed governance
– Protect patient privacy and the confidentiality of the therapeutic relationship
– Restore fair process: independent discipline, due process and the right to appeal
– Protect access to care and keep health professionals practising in BC

These four areas are not exhaustive. Other important issues continue to require attention, including timely access to psychological assessments for ICBC and WorkSafeBC claims, child custody and autism; regulation of counsellors and psychotherapists; clear definitions of discrimination alongside the Act’s important commitment to Indigenous cultural safety; and reducing administrative burdens that take professionals away from patient care.

What is the overriding problem of the HPOA?
The problem is the structure of the law itself: who appoints the boards, what powers they hold, and what rights professionals have. As of April 1, 2026, British Columbia became the first province in Canada to completely eliminate democratic elections for professional members on health regulatory boards. Under the Health Professions and Occupations Act (HPOA), the Minister of Health appoints every board member through a government-appointed process. Peer practitioner elections to those boards have ended. Traditional court appeal rights have been removed, and Colleges were amalgamated and reduced from 15 to 6 and stripped of their self-regulating independence.
Because the problem is structural, amendments to individual sections cannot fix it. We would welcome any step that restores independence, but the goal is a replacement of the HPOA built with the professions, with a structure that keeps politics out of health care.

For psychologists, the clearest example is privacy and confidentiality. Therapy only works when people trust that what they say is private. Under the Act, a government appointed regulator’s assessor can read a client’s confidential file without the client’s consent, and a psychologist who refuses can face misconduct findings and penalties. Some people will not seek help, and others may stop providing the information needed for their best care.

This is not only a psychology issue. Doctors of BC reports that 98% of its Representative Assembly members agreed that, without meaningful physician input, the Act would significantly raise health-system costs and reduce access to care. In our own survey, of BC psychologists, 68% of those who responded said they might leave the profession under the current framework. And since that survey, we have seen the impact actively unfolding. When experienced professionals leave, retire early, or reduce scope of practice, people wait longer for therapy, for primary care, and for the assessments that decide disability claims, custody and diagnoses. It is more efficient to support and retain a qualified health care professional than it is to replace them.

We support strong public protection, the Act’s anti-discrimination and Indigenous cultural safety provisions, and its support for people harmed by professionals. None of those goals requires political control of health regulation.

Hearing from the candidates
We are asking every candidate in this election one question: will you commit to repealing and replacing the HPOA with a law, built with the professions and the public, that keeps politics out of health care? We will publish every response exactly as received at www.hpoa-psychologists.com/election-2026.

On Wednesday, October 14 we are hosting a virtual town hall for health professionals; email us for details and registration. Email: hpoa.psychologists@gmail.com
We do not endorse or oppose any party or candidate.

Our advocacy continues
Whatever the outcome of the provincial election, we will continue to communicate with elected leaders of every party, with allied professions and with the public, to ensure that regulation protects the public and that health professionals have a meaningful voice in decisions affecting the care they provide and the patients they serve.

Sincerely,
Psychologists of BC for Ethical Care and Governance

Frequently asked questions

The Health Professions and Occupations Act (Bill 36, passed in 2022) took effect on April 1, 2026. It replaced the Health Professions Act and changes how doctors, nurses, psychologists, chiropractors, physiotherapist, naturopaths, and many other health professionals are regulated, investigated and disciplined.

Psychologists of BC for Ethical Care and Governance is an independent, non-partisan group of registered psychologists, working with allied health professionals, for ethical regulation that protects the public, client confidentiality and access to care.

The HPOA was introduced alongside claims that it would protect the public, and we fully support strong public safety, the Act’s anti-discrimination and Indigenous cultural safety provisions, and support for those harmed by professional misconduct. Our concern is the structure of the law: who appoints the boards, what powers they hold, and what rights professionals have. We believe that structure puts regulation under political control, which can erode public safety by compromising patient privacy, reducing independent oversight, and causing experienced professionals to leave the province, ultimately reducing access to care.

The concerns are about the structure: who appoints boards, what powers they hold, and what rights professionals have. Amendments to individual sections would not change that. We would welcome any step that restores independence, but the goal is a replacement built with the professions and a structure that keeps politics out of health care.

An election is the precise moment when commitments can change future legislation. Voters and health professionals deserve full transparency regarding where each candidate stands before casting a ballot, and a written commitment provides clear accountability that we can hold the next government to.

No. We do not endorse or oppose any party or candidate and we are not telling anyone how to vote. We asked every candidate the same question and we post every response exactly as received.

“Committed to repeal and replace” means the candidate chose option 1. “Supports amendments only” means option 2. “Not able to commit” means option 3. “Unclear” means the reply did not choose an option; we post their words as received. “No response yet” means we have not received a reply.

Reach out to them directly. Send a brief email to their campaign office, visit their local riding headquarters, or ask them face-to-face at a local all-candidates debate. Let them know that their response to the HPOA tracker matters to your profession and your vote.

Review this candidate tracker page and share the link directly with your colleagues and networks. If you are a health professional, you can also contribute to our data ask by sharing a confidential, anonymized example of how the HPOA affects your practice or your patients. Simply email us at hpoa.psychologists@gmail.com and we will send you the instructions for a secure submission.

Candidate Letter

The question we are asking every candidate

Will you commit to repealing the Health Professions and Occupations Act (HPOA) and replacing it with legislation, built with the professions and the public, that keeps politics out of health care?

Candidates were asked to reply:

1. Yes, I commit to repeal and replace.
2. I support amendments only.
3. I am not able to commit.

Why we are asking. The HPOA was introduced alongside claims that it would protect the public. But its structure puts every health regulator under political control, and that cannot be fixed one section at a time. Voters and health professionals deserve to know where each candidate stands before they vote.

How this works.

– Starting October 1, we are sending every candidate in the October 24 provincial election the same letter and the same question.

– Responses were requested by Friday, October 9 at 5 p.m.

– We will post every response on this page, live, on Saturday, October 10, and update it daily until the election on October 24.

– Responses are posted exactly as received. We do not edit or comment on them.

– We list candidates who have not responded.

– Advance voting is October 16 to 21.

Candidates: to respond, add context, or correct your entry, email hpoa.psychologists@gmail.com.

It would be entirely irresponsible to commit to a binary position before conducting thorough, evidence-based research into the real-world operational effects of the act. Bill 36 was rammed through after legislative debate was shut down by closure. Extensive consultation with all colleges is mandatory to ensure future amalgamations do not allow smaller professional groups, to be overtaken by larger ones. Severe college penalties for "misleading the public" risk creating inappropriately forced, state-acceptable speech. Furthermore, Section 50(1)(c)—mandating processes to identify structures, values, and attitudes that create discrimination—is deeply concerning. This wording implies an intrusive government standard on personal beliefs, creating a framework that risks punishing opposing opinions rather than protecting true professional integrity.7 Oct 26

Regulation should protect the public, but it must also protect professional independence, patient confidentiality, fair process, meaningful appeal rights and the ability of health professionals to exercise their judgment without unnecessary government interference. We should not create a regulatory system that drives experienced professionals to reduce their practices, retire early or leave B.C. For example, a dentist doesn't know the ins and outs of what doctor knows and vice versa. 2. Port Moody-Burquitlam 193 Port Moody-Burquitlam Wei Chou BC Green Party Admittedly, I need more information to understand this and repealing everything the last government did can be a profound decision without more clarity on the subject (ie. were there any policies that our psychologists in BC agree or disagree with in the HPOA that can be preserved or reformed?). Our ability to make improvements in our healthcare has often came from the hard work of political advocacy (whether parliamentarian, extra-parliamentarian, or extra-state direct action), tracing back to the origins of the CCF and the Tommy Douglas socialists who advocated for universal healthcare. Healthcare, whether public or private, is inherently political; because of the massive impact it has on our communities. Whether our healthcare systems can function, deliver, and adjust to changing demands in our society depends on the structures that affect accountability, power and autonomy, dissent, and transparency. These are some of the systemic aspects that I’d consider when weighing on this issue. It would be difficult to judge and broader consultation on the matter is warranted.9 Oct 26

Vernon-Lumby 335 Chantel Gibbs OneBC Yes I commit to repeal and replace The HPOA act ended the ability of the College of Physicians to regulate itself and gave the Minister of Health the power to appoint the board and do the discipline of wayward physicians. It also gives the Minister of Health the power to make vaccination of doctors mandatory in order to be licensed. I disagree with government doing this. Government officials are not practitioners and are not informed of all the new research in a field. The government is always two steps behind, so it should be the doctors themselves setting their standards of practice. The government can prosecute a doctor who harms someone due to neglect or sexual assault, etc. but the requirement to rat out someone for discrimination goes far beyond what a government should be concerned with and wanders into the realm of compelled speech, the same as we saw with Barry Neufeld and the Human Rights Tribunal.08 Oct 26
